TERMS & CONDITIONS FOR PROPERTY AND RV ACCOMMODATION 



 

Scope of Application 

  • These Terms and Conditions shall govern any accommodation agreements or any other related contracts entered into between the Property (referring to the motel and rv park located on site) and the guest (including all property guests, guests of tenants, guests of customers, and any rental of any length), and any matters not stipulated in the Terms and Conditions shall be governed by law and generally established customs. 
  • Any usage guidelines and precautions(hereinafter collectively referred to as “Rules”)presented by the Property in connection with these Terms and Conditions shall, in addition to the Property Rules and Regulations established by the Property and kept available to guests, constitute a part of these Terms and Conditions. 
  • Notwithstanding the preceding paragraph, any special agreements provided by the Property within the scope permitted by law and customs shall take precedence. 

 

Application for an Accommodation Agreement 

  • Those applying for an accommodation agreement at the Property shall provide the Property with the following information. 
  1. Guest name, telephone number, and valid state issued ID. 
  2. The date(s) of stay and estimated time of arrival 
  3. Accommodation fees(generally based on the Basic Accommodation Fees in Appendix 1. ) 
  4. Any information deemed necessary by judgement of management or owner based on situation. 
  • In the event that a guest requests to consecutively extend their stay beyond the date listed in(2)of the preceding paragraph, an amendment for a new accommodation agreement is deemed to have been made at the time the request was made. 

 

 

Establishment of the Accommodation Agreement 

  • The accommodation agreement shall be established when the Property accepts the application set forth in the preceding paragraph. However, this does not apply when the Property proves it has not accepted the application. 
  • When an accommodation agreement has been established as per the provisions of the preceding paragraph, the guest must pay a deposit set by the Property by the deadline designated by the Property. 
  • The deposit shall first be allocated to room charges ultimately payable by the guest, then allocated to fines followed by compensation for damages in the event that the provisions of Articles 6 and 21 apply; any remaining deposit shall be returned at the time of payment in accordance with Terms and Conditions. 
  • The accommodation agreement shall cease to be effective when the guest fails to pay the deposit set forth in bulletin 2 by the deadline designated by the Property. However, this is limited to cases in which the Property notifies guests of a deposit deadline. 
  • Guest must be 21 years or older to enter into accommodation agreement. 

 

Special Agreements Not Requiring a Deposit 

  • Notwithstanding the provisions of bulletin 2 of the preceding article, the Property may accept special agreements that do not require payment of a deposit. 
  • The preceding paragraph on special agreements shall apply when the Property does not request payment of the deposit set forth in bulletin 2 of the preceding article or does not specify a deposit payment deadline when accepting applications for an accommodation agreement. 

 

Refusal of Accommodation Agreements 

This Property, based on owner and manager discretion, may refuse to enter into an accommodation agreement in the following cases: 

  1. When the accommodation application violates the stipulations of these Terms and Conditions. 
  2. When guestrooms are fully booked or occupied 
  3. When a potential guest is deemed likely to break the law, disrupt public order, or act contrary to public morals during their stay. 
  4. When a potential guest is deemed to fall under any of the following categories(a)to(c):
    a. An organized crime group under the Act on Prevention of Unjust Acts by Organized Crime Group Members(Act No. 77 of 1991)as stipulated in Article 2(2)(hereinafter “organized crime group”), a member of an organized crime group as stipulated in Article 2(6)(hereinafter “organized crime group member”), an associate member or affiliate of an organized crime group or any other antisocial force
    b. When the applicant is involved in corporations or other organizations whose operations are controlled by an organized crime group.
    c. When any of the directors of the applicant’s corporation is classified as a member of an organized crime group 
  5. When the potential guest’s behavior poses a significant nuisance to other guests or employees. This includes public intoxication. 
  6. When the potential guest clearly has a contagious disease or virus. 
  7. When the potential guest uses violence, threats, blackmail, or intimidation to make unjust or unreasonable demands against the Property or its employees, or is deemed to have engaged in any similar acts in the past. 
  8. When the Property is unable to accommodate guests due to natural disaster, facility malfunction, or other inevitable circumstances. 
  9. When the potential guest is intoxicated, exhibits or has exhibited extremely abnormal behavior that may pose a nuisance to other guests or employees, or in cases that fall under the provisions of prefectural ordinances. 
  10. When the potential guest is extremely unsanitary or is wearing extremely dirty clothes that may cause a nuisance to other guests or employees. 
  11. When the potential guest conceals the fact that they have reserved a guestroom within the Property for the purpose of making a profit, either for themselves or for a third party, by selling goods, etc. 
  12. When the potential guest does not comply with these Terms and Conditions or with cancellation and payment policies when making a reservation. 

 

Reservation and Cancellation Policy 

  • Your confirmed reservation is guaranteed until the day of arrival. After that time, if guest fails to appear or contact in advance, the reservation will no longer be guaranteed and the room may be reassigned. The Property will charge guests credit or debit card within 48 hours prior to arrival of your confirmed reservation for cost of first night. 
  • The hotel has the right to cancel your reservation if we do not receive the applicable Pre-Payment Deposit. Property is not responsible for notification of cancellation if due to non-payment, but will attempt to contact guest to correct reservation payment. 
  • Guest must be 21 years or older to make a valid reservation. Guests will be asked to provide a valid state issued id, or passport at time of check in validating age. 
  • Guest shall not exceed max room occupation rates as listed in the Terms and Conditions 
  • Those applying for a reservation at the Property shall provide the Property with the following information: 
  1. Guest name, telephone number, and valid state issued ID. 
  2. The date(s) of stay and estimated time of arrival 
  3. Accommodation fees(generally based on the Basic Accommodation Fees in Appendix 1. ) 
  4. Any information deemed necessary by judgement of management or owner based on situation. 
  • Room rates are subject to change after reservation is made with notification to guest. 
  • All reservations are subject cancellation if guest submits false information in application for accommodation agreement. 
  • If guest cancels more than 7 days in advance, the total amount of the reservation will be refunded. 
  • If guest cancels within 7 days of reservation the guest will be charged the cost of the first night. 
  • There is only one way in which we can acknowledge cancellation of the guest’s reservation; the guest must send a cancellation request stating the reservation number via email to either the booking agency guest originally booked with, or by contacting the Property directly. 
  • All cancellations are confirmed via email immediately after the reservation has been cancelled. 

 

 

The Guest’s Right to Terminate the Accommodation Agreement 

  • Guests may request that the Property management or owner terminate the accommodation agreement. 
  • If the accommodation agreement is terminated in full or in part for reasons attributable to the guest, the Property shall charge a penalty in accordance with the provisions of Attached Table 2 (only in cases where the Property specifies a deposit payment deadline and requests payment as stipulated previously and excludes cases in which the guest cancels the accommodation agreement prior to such payment). However, in the event that the Property accepts a special agreement as stipulated previously, guests are only required to pay a penalty for terminating the accommodation agreement when they have been notified of this obligation. 
  • If the guest does not arrive by 10 pm or two hours after a scheduled arrival time arranged in advance on the day of their stay without contacting the Property, the accommodation agreement may be deemed to have been terminated by the guest. 

 

The Property’s Right to Terminate the Accommodation Agreement 

  • The Property may terminate the accommodation agreement in the following cases 
  1. When the guest is deemed likely to break the law, disrupt public order, or act contrary to public morals, or has engaged in such acts, during their stay. 
  2. When the guest is deemed to fall under any of the following categories(a) to(c):
    a. An organized crime group or a member, associate member, or affiliate of an organized crime group or any other antisocial force
    b. When the applicant is involved in corporations or other organizations whose operations are controlled by an organized crime group.
    c. When any of the directors of the applicant’s corporation is classified as a member of an organized crime group 
  3. When the guest’s behavior poses a significant nuisance to other guests or employees. This includes public intoxication. 
  4. When the guest clearly has a contagious disease or virus. 
  5. When the guest uses violence, threats, blackmail, or intimidation to make unjust or unreasonable demands against the Property or its employees, or is deemed to have engaged in any similar acts in the past. 
  6. When the guest cannot be accommodated due to act of God. 
  7. When the guest is intoxicated, exhibits or has exhibited extremely abnormal behavior that may pose a nuisance to other guests, or in cases that fall under the provisions of prefectural ordinances. 
  8. When the guest smokes in bed, messes with firefighting equipment, or otherwise violates the Property Rules and Regulations(limited to fire-related regulations). 
  9. When the guest conceals the fact that they have reserved a guestroom within the Property for the purpose of making a profit, either for themselves or for a third party, by selling goods, etc. 
  10. When the guest violates the Property Rules and Regulations stipulated forthcoming, commits any of the prohibited acts set by Property, or otherwise fails to comply with these Terms and Conditions or with rules on cancellation and payment when making a reservation. 
  • When the Property cancels the accommodation agreement in accordance with the provisions of the preceding paragraph, the guest will not be charged for services not yet provided, but guests are responsible for payment of time stayed and any applicable fees and taxes. 

 

Guest Registration 

  • Guests must register the following information at the front desk on the first day of their stay. 
  1. Guest name, age, address, contact telephone number, and state issued ID. 
  2. Departure date and planned departure time if past standard check out time. 
  3. Other information deemed necessary by the Property. 
  • International guests who do not have an address in America are subject to present a scan or copy of their passport, register their nationality, passport number, port of entry, and immigration date in addition to the information listed above. 
  • Guests who wish to pay the fees stipulated by Property using traveler’s checks, Property vouchers, credit cards, or any other alternative form of currency must present this in advance when registering the information above. Be aware currency payment will not be accepted if the Property has notified the guest in advance that currency is not accepted. 
  • Children under the age of 12 stay free of charge. Please inquire with front desk about how many children are staying with guest. 

 

Guestroom Hours and Check-In/ Check-Out 

  • Guestrooms may be used from 3 pm to 11 am the following day. However, for extended stays, guests may use the guestroom for the entire day excluding arrival and departure dates. 
  • Guests may check in at the front office between 3pm and 7pm. Any check-ins outside of this timeframe must be approved of by management. Non communication of special check-in times will be considered a cancelled reservation and guest will be responsible for full price of reservation. 
  • The balance of the full rental amount is payable on arrival at check-in time. Check-in can not be completed until full payment and applicable security deposits have been received and approved. 
  • Guests may check-out any time up until 11AM by local time. Later check-out ties may be requested, although Property does not guarantee availability. 
  • Notwithstanding the provisions of the preceding paragraph, the Property may allow guests to use guestrooms outside the hours specified above. In doing so, the following extension fees will be charged: 
  1. Until 2:00 pm: $15 per hour per guestroom 
  2. After 2:00 pm: Full room rate 
  • If guest check out after 11am without notification and approval from management, the full room rate will be charged to the guests card and removal from room is still required. 
  • Keys are to be left in room or returned directly to the front office for check-out. 
  • A more detailed inspection of the room is made after the check-out time and the Property reserves the right to make charges for any damages or breakages found before the room is occupied again. 
  • All linen and room amenities are to be left in the room upon checkout. Any stolen or missing items will be charged to the guests card. 
  • If a security deposit was given, it will be released after room inspection. Deposits paid on credit or debit cards will be released within 3 business days. The Property is not responsible for holds made by the bank. Once released from Property, deposit may take 15-21 days to return to guests account. 

 

Compliance with the Property Rules and Regulations 

  • Guests shall comply with these Terms and Conditions as well as Rules while staying at the Property or be subject to eviction and removal from premises and responsible for payment of all fees and taxes applicable. 

 

Playground Policy and Rules 

  • Adult supervision recommended. Play at guests own risk. 
  • The playground is open to and only intended for guests of the Property. 
  • Use of the equipment on playground should only be used as intended. 
  • Ramps are for wheelchairs and other disability aids – no bikes, skateboards, rollerblades, or any other wheeled device. 
  • There is no rough housing, shoving, hitting, violence, or misappropriate actions allowed. 
  • Appropriate footwear is required for playground use. 

 

 

 

 

ADA Policy 

  • The Property has limited rooms that are compliant with the Americans with Disabilities Act (ADA). Please ensure all requests reach us by confirming with management if ADA accessibility is needed. 
  • Our office has a ramp to allow easy access for anyone as well as both of our ADA rooms. 
  • The playground is also considered ADA and is open to any of our guests! 

 

Smoking Policy 

  • All of our rooms for overnight rental are smoke free, unless otherwise specified. 
  • By agreeing to these Terms and Conditions guest agrees to pay a $200 fine if any evidence of smoking is found in the rooms or any of the building areas, such as window ledges, indoor trashcans, bathroom, etc. 
  • Smoking is allowed outside at least 50 feet from any building entrance. 
  • Any items damaged by smoke, fire, or staining from smoking are subject to be charged to guests card for compensation to the Property. 

 

 

Pet Policy 

  • Pets are welcome at the Property! We do have a few restrictions, but generally all of our rooms are pet friendly. 
  • A maximum of two pets are allowed without special permissions from management. 
  • Pets are to use the bathroom in grassy areas and are to be picked up after by owner. Public dumpster and trash cans are provided to dispose of bagged pet waste. 
  • All pets must remain on a leash or similar restraining device. 
  • Pets are not allowed to be left unattended in rooms. 
  • Pets require a $25 deposit for the first 2 pets, $25 per additional approved pet after. 
  • Pet owners are responsible for any damages to room caused by pets including: scratches, damaged furniture, stained furniture, excessive hair left in room, fecal or urine clean up, odor, or any other reasonably noticeable damages to the room. Cost of damages are determined by management based on situation. 

 

 

Prohibited Acts 

  • Guests shall not engage in the following acts, either on their own or through the use of a third party. 
  1. Registering or providing false information when staying at the Property. 
  2. More guests stay in the property than registered and agreed. 
  3. Sub-letting the property you have rented (or giving it to other people) Guest count should match name and quantity of reservation. Accommodation for additional guests is permitted. 
  4. Using fraudulent payment methods such as stolen credit cards when staying at the Property. 
  5. Using the Property for business purposes without permission from the Property. 
  6. Mass booking followed by mass cancellation or any similar acts. 
  7. Repeatedly making and canceling bookings without a justifiable reason, or any similar acts. 
  8. Impersonating the Property or the Property group, or any act that could be mistaken for such. 
  9. Unauthorized access of systems or computers or any similar acts. 
  10. Sending or uploading harmful computer programs or any similar acts. 
  11. Removal, defacing, or destroying equipment within the Property facilities, or any similar acts. 
  12. Obstruction of business or damaging the reputation or brand of the Property or Property group by making demands that exceed socially acceptable norms, or slandering, defaming, threatening, or harassing the Property or its staff or posting inflammatory remarks on social networking sites, or any similar acts. 
  13. Public intoxication is not allowed. Open containers are not allowed. If guest wants to consume alcohol it must be done in a covered and non marked container if outside the room, and guest is not allowed to be intoxicated and behaving in an obnoxious behavior to guests or employees of the Property. 
  14. Alcohol is only allowed to be consumed by adults 21 years old and up. 
  15. Violence, threats, extortion, or other coercive and unreasonable demands against the Property or its staff. 
  16. Any acts that cause or risk causing inconvenience, damage, or disadvantage to other guests, third parties, the Property, or the Property group. 
  17. Any acts that infringe or risk infringing on the copyrights, trademarks, or other intellectual property rights, privacy rights, personal rights, or any other rights of other guests, third parties, the Property, or the Property group. 
  18. Acts that violate or risk violating public order or law, or any criminal acts. 
  19. Room must have a guest of 21 years or older to be occupied. Guests under 21 can not occupy a room without an adult of the age of 21 present. 
  20. Displaying the power of an organized crime group or acts of aiding and abetting an organized crime group. 
  21. Violation of any other provisions of these Terms and Conditions. 
  22. Violation of any other rules in the Property Rules and Regulations. 
  23. Any other acts deemed inappropriate by the Property. 
  • The Property shall be entitled to claim compensation from the guest for any damages incurred as a result of the acts in the preceding paragraph. 

Hours 

  • Hours for the front desk, cashier, and other major facilities of the Property are as follows. For detailed information on hours for other facilities, please see the attached pamphlet, signs throughout the Property, or the service directory in the guestrooms. 
  1. Closing time, front entrance: 10:00pm 
  2. Front desk: 24 hours/day on call service. 
  3. Cashier: 2:00pm – 10:00pm 
  • The hours in the preceding clause may be temporarily changed when doing so is necessary and unavoidable. The Property shall take appropriate measures to notify guests of such changes. 

Payment of Fees 

  • A breakdown of accommodation fees to be paid by guests is listed in Appendix 1. 
  • The accommodation fees in the preceding paragraph must be paid at the front desk on the day of the guest’s arrival or upon the Property’s request, Property vouchers, credit/debit cards, or any other alternative for currency accepted by the Property. However, be aware currency payment will not be accepted if the Property has notified the guest in advance that currency is not accepted. 
  • The accommodation fee will still be charged if the guest voluntarily chooses not to stay in an available room provided by the Property. 

 

Property Liability 

  • The Property shall compensate the guest for any damages arising from failure to execute the accommodation agreement or its related agreements. However, this shall not apply when damages are caused by reasons not directly attributable to the Property. 
  • The responsibility to provide guests with a room on the part of the Property starts when the guest checks in at the front desk of the Property and ends at the checkout deadline. 
  • The Property is enrolled in Property liability insurance to protect against fire and other disasters. 

When Rooms Cannot Be Provided According to the Agreement 

  • If the Property is unable to provide a guestroom according to the agreement, the Property shall, with the understanding of the guest, strive, but not guarantee, to find accommodations at another Property with as similar conditions as possible, but Property is not responsible for payment of new found accommodations. Some fees may still apply. 
  • Notwithstanding the preceding paragraph, if the Property is unable to find other accommodations, the Property will pay a refund equivalent to the original amount charged. However, this compensation will not be paid when inability to provide a guestroom is for reasons not attributable to the Property. 

Handling of Checked Items 

  • Loss or damage to any items, cash, or valuables checked at the front desk shall be compensated by the Property, except in cases when such loss or damage is caused by act of God. However, if the guest fails to declare with proof the type and amount of valuables or cash when asked to do so by the Property, the Property will not compensate. 
  • Loss or damage to items, cash, or valuables not checked at the front desk shall be compensated only when such loss or damage is caused by willful misconduct or negligence on the part of the Property. However, if the guest has not declared with proof the type and amount of such items in advance, the Property will not compensate. 
  • Artwork, antiques, other easily damaged items, and any item declined at managements discretion cannot be checked at the front desk. 

Storing Guest Luggage and Belongings 

  • The Property shall store guest luggage arriving before its owners only when an arrangement has been made in advance, and shall hand it to the guest during check-in. If luggage arrives without prior arrangement it will be returned to sender at senders cost. 
  • In the event that luggage or personal belongings are left unattended at the Property after the guest has checked out, the Property will, in principle, wait for the owner to contact the Property for further instructions, the Property is not responsible for reaching out to guest. If the owner fails to provide instructions or if the owner is unknown, valuables and items containing personal information will be delivered to the nearest police station within seven(7)days of the date of discovery, while other items will be disposed of two(2)months from the date of discovery. The same shall apply to items not taken in by the police. Please be aware the food, drink, cigarettes, magazines, and other items detrimental to sanitation will be disposed of on the same day. 
  • Liability on the part of the Property for guest luggage or belongings shall be governed by prior paragraphs in “Handling of checked items” bulletin 1 and 2. 

Housekeeping 

  • When a guest stays in the same room for more than one consecutive night, housekeeping will be performed only upon request of the guest. 
  • Even if we receive a request stating that housekeeping is not required, housekeeping will be performed every fourth night to maintain sanitary conditions. However, the Property retains the right to clean guestrooms at any time if it is deemed necessary. Guestrooms may also be entered on days other than cleaning days for maintenance, legal inspections, and emergencies. 
  • The guest shall not be able to refuse the housekeeping set forth in the preceding paragraph. 
  • If guests refuse housekeeping during any reasonable, or necessary time deemed by management or ownership, guest(s) are subject to dismissal and ejection from premises and are responsible for full payment of time stayed and applicable fees. 
  • Each room contains a envelope for tips to the cleaning staff. Monies left in envelopes will not be counted towards rent, fees, or taxes. All money left in envelopes goes directly to housekeeping. 

 

Computer Networks 

  • Guests shall use computer networks at the Property at their own risk. Service may be interrupted or terminated due to system failure or other reasons without prior notice. The Property shall not be liable for any loss or damage incurred as a result of service interruption due to system failure or any other reason when using computer networks. 
  • If the guest uses Property computer networks in a way deemed inappropriate by the Property that may cause or has actually caused damages, the Property will demand that the guest cease use immediately and compensate for any damages incurred. 

 

Parking Liability 

  • The Property consents to let guests park their vehicles in the parking space when a guest uses the Property parking lot, regardless of whether the guest has deposited the keys with the Property, and the Property shall not be held liable for management of the vehicle. Guest parks vehicle at own risk. 
  • The Property does not take responsibility or accept liability for damage, accident, or loss to your vehicle or personal property. 
  • The Property does not guarantee parking for more than one vehicle per room, but does allow up to 2 cars per room if parking is not full. 
  • Vehicles parked in parking lot are not to be of a nuisance to other guests by noise violations or blocking entrance and exit of parking lot. 

 

Firearms Policy 

  • Any guest in possession of a firearm on hotel premises is personally responsible for registering every firearm in possession with the front office, along with proof of ID for guest responsible for firearm. 
  • Any guest or visitor who is in possession of a firearm on hotel premises is personally responsible for abiding by all applicable federal, state, and local laws with respect to firearms. 
  • Guests who fail to abide by this firearm policy may be asked to leave the hotel premises, without refund. The hotel premises are private property, and our firearms policy applies to: 
  1. All firearms, regardless of whether the firearm is a non functioning show gun, a handgun, short barrel rifles, or a long-barreled gun 
  2. All guests and visitors, even those possessing a valid license or permit to carry a firearm. 
  • Subject to the following restrictions, guests of Property who are lawfully permitted to possess a firearm may bring such firearm onto hotel premises, provided that the presence of the firearm on hotel premises: 
  1. Firearm is for storage purposes only 
  2. The firearm is and remains at all times unloaded, unless preparing to leave the property. 
  3. The firearm is and remains secured in a locked, hard-sided firearm container, provided by the guest, while transported to or from the guest room and while stored therein 
  4. The firearm remains securely safeguarded at all times in a locked guest room or locked personal vehicle, except when transporting the firearm to or from a guest room. 

 

 

Guest Liability and Safety Policy 

  • Employees will not disclose the identity, room number, or presence of a guest to anyone other than appropriate law enforcement. This includes the taking of or delivery of messages or indirect forwarding of phone calls. 
  • It is the responsibility of guests to communicate their presence and room number to any person they wish to receive calls or visits from. 
  • All guests and staff are to be treated fairly and equally. Guest and staff safety is part of our commitment to having a safe and prejudice free environment. 
  • The guest shall compensate the Property for any damages to the Property caused by willful misconduct or negligence on the part of the guest(including but not limited to facility repair costs and lost sales opportunities). 

 

Exemptions 

  • The Property shall be exempt from liability when an exemption set forth in local laws, these Terms and Conditions, or the Rules and Regulations applies. 

 

Reporting to the Authorities 

  • Should a guest’s violation of these Terms and Conditions or other Rules warrant protection of the rights, property, or services of another guest or the Property, the Property will notify the police and other relevant authorities or otherwise take appropriate measures, though the Property is not responsible for contacting authorities until knowledge of violation is known to management. 
  • Should the Property deem that a guest’s health or life be in serious danger, the Property may call an ambulance, regardless of the guest’s will. The Property is not responsible for any medical cost or occurrence associated with ambulance or any other medical bills. 

 

Changes to the Agreement 

  • These Terms and Conditions are subject to change without notice. Check the official website, or front office for the latest information. 
  • Use of the Property by the guest after changes to these Terms and Conditions constitutes consent to the amended agreement. 
  • Notwithstanding the preceding paragraph, the provisions prior to the change shall apply to accommodation agreements concluded prior to the change of these Terms and Conditions. 

 

Severability 

  • Even when a portion of these Terms and Conditions or other Rules is deemed legally invalid, the remaining provisions shall remain valid. 
  • Even when a portion of these Terms and Conditions or other Rules is deemed invalid or revoked in relation to a particular guest, the Terms and Conditions and other Rules shall remain valid for all other guests. 

 

Preferred Language 

  • The English version of these Terms and Conditions and other Rules shall be the original document. Even when translations are provided to guests for reference, only the original English document shall be contractually valid, and the translated document shall have no validity whatsoever. When agreeing to Terms and Conditions, guest is validating the English version. 

 

Good Faith Negotiation 

  • The Property and guest shall negotiate in good faith to resolve any problems arising in connection with use of the Property that cannot be resolved under these Terms and Conditions. 

 

Governing Law and Court of Jurisdiction 

  • The accommodation agreement between the Property and the guest shall be governed by the laws of North Carolina, and The United States of America. 
  • The Haywood County court or the Haywood County Magistrates office shall have exclusive jurisdiction in the first instance over any disputes(including court mediation procedures)regarding the accommodation agreement between the Property and the guest.

Appendix 2. Penalties 

Notes 

  • Percentages are the ratio of the penalty charge to the basic accommodation fee. 
  • If the length of stay is shortened from the original agreement, the Property shall charge a penalty of one day(the first day), regardless of the number of days the length of stay was shortened. 
  • A separate penalty policy established by the Property may apply to agreements for group plans(15 or more guests)or accommodation plans sold online. In such cases, the applicable penalty policy shall prevail over these Terms and Conditions. 

<Property Rules and Regulation> 

We ask that guests abide by these Property Rules and Regulations to ensure that the Property remains a public space and to ensure the safety and comfort of our guests (including daytime guests using rooms for teleworking, etc.; the same shall apply hereinafter). Guests who fail to abide by these rules may be refused further lodging or use of the Property's facilities. Such guests may also be asked to pay for any damage caused to fixtures or equipment within the Property. 

 

<Prohibited Actions> 

  1. Do not use guestrooms for purposes other than lodging without permission from the Property. 
  2. Do not use open flames for heating or cooking in the guestrooms, corridors, or other common areas. 
  3. Do not smoke in non-smoking rooms (including smoking with e-cigarettes, heat-not-burn-tobacco, etc.). If smoking or cigarette butts are found in anon-smoking room, we will charge to the guest 10,000 yen as room cleaning feeand room damage compensation in addition to the room charge. Do not smoke in bed or other areas prone to catching fire, even when staying in a smoking room. 
  4. Use the lobby to meet with outside visitors. Do not invite outside visitors into your guestroom. 
  5. Do not move equipment or fixtures within the Property or guestrooms from their designated locations without reason. 
  6. Do not change or modify the current state of equipment within the Property or guestrooms without permission. 
  7. Do not enter storage rooms, machinery rooms, emergency stairs (except during emergencies), or other staff-only areas. 
  8. Do not bring the following items into the Property:
    a. Dogs (excluding assistance dogs for the disabled), cats, birds, and other animals, or pets in general unless granted specific permission.
    b. Items that emit a foul or strong odor
    c. Excessively heavy objects or an excessive amount of objects
    d. Guns, swords, or other weapons
    e. Explosives, volatile oils, or other items that are flammable or easily ignited
    f. Other items deemed a threat to the safety of other guests 
  9. Do not shout, sing, act in a way that causes powerful shaking or a commotion, or otherwise pose a nuisance or cause discomfort to other guests. 
  10. Do not engage in any gambling, immoral acts, or acts that disrupt public safety within the Property or guestrooms. 
  11. Do not distribute advertisements or promotional materials, sell goods, or conduct business without permission. 
  12. Do not distribute leaflets, petition for signatures, engage in political or religious activities, hold meetings, display group or organizational power, or aid or abet such activities without permission. 
  13. Do not bring or park propaganda trucks, modified cars, or any other style of vehicle that the Property deems may cause discomfort or inconvenience to other guests. 
  14. Do not leave personal belongings in the corridor or lobby. 
  15. Photography or filming that may pose a nuisance to other guests within the Property or guestrooms is strictly prohibited. 
  16. Do not photograph or film the inside of the Property for business purposes without permission from the Property. 
  17. Assault, injury, threats, extortion, fraud, obstruction of business, unreasonable demands through intimidation, and any similar acts are prohibited. 
  18. Do not engage in intoxicated behavior that may cause inconvenience to guests and employees. 
  19. Do not engage in any other acts deemed inappropriate by the Property. 

 

<Precautions> 

  1. As a general rule, items left with the Property will be disposed of within three (3) months of the date of deposit unless otherwise specified. 
  2. As a general rule, the Property waits for contact from the owner regarding instructions on what to do with lost or found items. If the owner fails to provide instructions or if the owner is unknown, valuables and items containing personal information will be delivered to the nearest police station within seven (7) days of the date of discovery, while other items will be disposed of three (3) months from the date of discovery. Please be aware the food, drink, cigarettes, magazines, and other items detrimental to sanitation will be disposed of on the same day. 
  3. Please note that using the guestroom telephone to place a call outside the Property will incur a facility usage fee. 
  4. Housekeeping will be performed only for guests who request it. Even if we receive a request stating that housekeeping is not required, housekeeping will be performed every fourth night to maintain sanitary conditions. However, the Property retains the right to clean guestrooms at any time if it is deemed necessary. Guestrooms may also be entered on days other than cleaning days for maintenance, legal inspections, and emergencies. 
  5. Should a guest’s behavior warrant protection of the rights, property, or services of the Property or another guest, the Property will notify the police and other relevant authorities or otherwise take appropriate measures. 
  6. Should the Property deem that a guest’s health or life be in serious danger, the Property may call an ambulance, regardless of the guest’s will. 
  7. If you lose your room key and cannot find it by the checkout time, JPY 1,000 will be charged to issue a new one. 

 

<Refusal of Service> 

  1. Service will be refused to the following organizations and individuals:
    a. Organized crime groups and their members, affiliates, or any other persons involved in organized crime
    b. Individuals involved in corporations or other organizations whose operations are controlled by an organized crime group.
    c. Antisocial forces and their members and affiliates 
  2. Individuals who, due to diminished capacity or drug use, are unable to ensure their own safety and pose a risk or cause fear or discomfort to other guests. 
  3. Individuals who fail to immediately cease any of the aforementioned prohibited acts after receiving a warning from the Property.
